Welcome to SparkDate. These Terms of Service ("Terms") govern your access to and use of the SparkDate website, mobile applications, and in-person events (collectively, the "Services") operated by Ancapital Group LLC ("SparkDate," "we," "us," "our"). By creating an account or attending a SparkDate event, you agree to these Terms.
1. Eligibility
You must be at least 21 years old and legally able to enter binding contracts to use SparkDate. SparkDate events may serve alcohol; attendance by minors is strictly prohibited. By using the Services, you represent and warrant that you meet these requirements.
2. Your Account
Account Creation
You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
Identity Verification
For safety, SparkDate may require identity verification. Misrepresentation of identity, age, or relationship status is grounds for immediate account termination.
3. Tickets, Memberships, and Billing
Event Tickets
Event tickets are one-time purchases processed via Stripe. Buying a ticket does not enroll you in a membership, subscription, free trial, or any recurring charge. All amounts are in U.S. dollars.
Memberships (Coming Soon)
SparkDate plans to offer paid membership tiers in the future. Memberships are not yet available, and no membership or subscription fees are currently charged. When memberships launch, these Terms will be updated with the applicable pricing, trial, renewal, and cancellation terms before any recurring billing takes effect — and you will only be billed if you explicitly sign up for a membership.
Ticket Sales
All ticket sales are final. If you can't attend, you may transfer your ticket to another eligible guest.
4. Events
Event Conduct
SparkDate events take place at third-party venues. By attending, you agree to:
- Comply with all venue rules and applicable laws
- Treat all attendees, staff, and venue personnel with respect
- Refrain from harassment, intimidation, or discriminatory behavior
- Drink responsibly and arrange safe transportation
- Present valid government-issued ID upon request
Removal from Events
SparkDate and our venue partners reserve absolute discretion to refuse service, remove any attendee from an event, or revoke account access for conduct deemed inappropriate, including but not limited to intoxication, harassment, or violations of venue policies. Ticket sales remain final in such cases.
5. Community Guidelines
SparkDate is built on respect and authenticity. The following are strictly prohibited:
- Sexual harassment of any kind
- Discrimination based on race, gender, sexual orientation, religion, or any protected class
- Solicitation, sex work, or commercial activity at events
- Catfishing, identity misrepresentation, or use of false photos
- Sharing of another member's personal information without consent
- Recording or photographing members without explicit consent
Violations result in immediate, permanent account termination. Serious violations may be reported to law enforcement.
6. Member-to-Member Interactions
SparkDate facilitates introductions but is not responsible for the conduct or character of any member. You are solely responsible for your interactions with other members. We strongly recommend:
- Meeting in public for follow-up dates
- Telling a friend where you'll be
- Trusting your instincts
- Reporting any concerning behavior to [email protected]
7. Intellectual Property
All SparkDate content, branding, software, and event programming are the exclusive property of Ancapital Group LLC. You may not reproduce, distribute, or create derivative works without written permission.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPARKDATE, ANCAPITAL GROUP LLC, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL LIABILITY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR INTERACTIONS WITH OTHER MEMBERS.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO SPARKDATE IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless SparkDate from any claims, damages, or expenses arising from your conduct at events, your interactions with other members, or your violation of these Terms.
10. Dispute Resolution
Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in Philadelphia, Pennsylvania. You waive the right to participate in class actions.
Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
11. Termination
You may terminate your account at any time via account settings. SparkDate may suspend or terminate your account for violations of these Terms, with or without notice. Upon termination, your right to access the Services ends immediately.
12. Changes to These Terms
We may update these Terms periodically. Material changes will be communicated via email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
